[HR & Labor] Legal Advice Provided on Compliance with the 52-Hour Workweek System and Implementation of Flexible Work Arrangements

In preparation for the implementation of the 52-hour workweek system, EJE LAW advised a foreign-invested financial investment company, enabling the client to introduce a customized flexible work arrangement through a labor-management agreement, effective from January 2020.


The Employment/Labor Team at EJE LAW conducted a detailed analysis of each department’s roles and job functions within the client company, and proposed a practical and tailored solution, including the adoption of selective working hours and discretionary working hours systems. Through clear guidance on the criteria for what constitutes working hours in various individual cases, the firm's advice enabled the client’s employees to better understand the applicable standards, ensure compliance with the 52-hour workweek, and improve focus and productivity while respecting individual autonomy. The flexible work arrangement was successfully implemented through a formal labor-management agreement, serving as a model case of regulatory compliance and internal consensus.
