In June 2021, EJE LAW successfully represented clients in a case involving alleged unfair concerted action among freight transportation companies serving the United States Forces Korea (USFK). As a result of the firm’s representation, the Korea Fair Trade Commission (KFTC) concluded the case with a corrective order only, waiving the imposition of surcharges. Although the case involved allegations of collusion among contractors transporting goods for the USFK, EJE LAW effectively demonstrated that the actual implementation and economic impact of the alleged agreement were minimal compared to its stated terms. This led the KFTC to issue a remedial order without imposing any administrative fines.
Although it was difficult to completely deny the existence of the unfair concerted action in this case, EJE LAW persuasively argued—through various legal and factual angles—that there was no necessity for punitive measures. As a result, the KFTC waived the imposition of surcharges for all involved companies, which is regarded as a notable advocacy achievement in the context of the case.
