[Employment / Labor] Victory in Administrative Litigation Concerning a Freelance Announcer under a Service Contract with a Terrestrial Broadcaster

On July 4, 2019, EJE LAW secured a favorable judgment before the Seoul Administrative Court, successfully representing a freelance announcer who had entered into a service contract with a major terrestrial broadcaster, “Company M”, and was terminated upon the expiration of the contract period. The court upheld the Central Labor Relations Commission’s decision, finding that the ruling on unjust dismissal relief was lawful. The key issue in this case was whether the announcer qualified as an employee, particularly in light of whether Company M exercised control and supervision over the announcer.


This case is significant in that it represents the first court ruling to recognize employee status for an announcer who entered into a freelance service contract with a broadcasting company, and to determine that the non-renewal of the contract after five years of continuous service constituted an unjust dismissal.
