[Fair Trade] Case Involving Mediation by the Korea Fair Trade Mediation Agency in Relation to the Agency Business Sector

In June 2020, EJE LAW represented a Korean agency in a mediation proceeding before the Korea Fair Trade Mediation Agency, involving claims against a global manufacturer for violations of the Fair Agency Transactions Act and the Fair Trade Act. As a result of its representation, EJE LAW successfully secured a significant mediation decision on behalf of the agency.


This case involved a long-standing agency relationship in which the abuse of superior bargaining position had allegedly occurred over time, operating at the margins of legality. While the evidence and legal clarity were limited, EJE LAW adopted a comprehensive approach by analyzing various factors, including fluctuations in supply prices, changes in inventory levels, and shifts in customer accounts. Based on this analysis, the firm argued that an abuse of bargaining position had indeed taken place, and ultimately secured a mediation decision from the Korea Fair Trade Mediation Agency that included substantial compensation for the agency client.


This case is considered a noteworthy precedent for mediation, particularly in situations where insufficient evidence or a lack of clearly unlawful conduct makes it difficult to pursue formal complaints or civil litigation.
